Through this verdict, the Supreme Judicial Council regained the power to remove judges. A bench of 6 judges headed by Chief Justice Syed Refat Ahmed gave this verdict on Sunday.

The Appellate Division disposed of the review petition against the judgment of the Appellate Division declaring the Sixteenth Amendment of the Constitution invalid and null and void by bringing the much-discussed power of removal of judges into the hands of the members of Parliament. As a result, the verdict of repealing the 16th Amendment will be upheld, said the lawyer. Henceforth, the Supreme Judicial Council will have the power to remove judges.

However, in 1975, the President was given this power in the Fourth Amendment of the Constitution. Later, the Supreme Judicial Council was created to deal with the impeachment of judges again in the Fifth Amendment. After that, from the fifth to the fifteenth amendment, no new amendment came with the removal of judges. However, in 2014, the National Parliament was empowered to remove judges in the 16th Amendment. At the initiative of the then Chief Justice SK Sinha, the High Court and the Appellate Division quashed the Sixteenth Amendment. Later Awami League government went to its review.
