Jumbangla Desk: A writ petition has been filed in the High Court seeking directions to the government to publish the gazette declaring the interim government as a 'revolutionary government'. The writ petition also sought an order declaring the government's inaction in not publishing the gazette illegal.
At the same time, directions have been sought for the publication of the gazette announcing that those who sacrificed their lives and those injured in the July revolution will be honored as 'freedom fighters'.
Barrister ASM Shahriar Kabir filed the writ on behalf of freedom fighter Mofazzal Hossain on Wednesday (October 23).
In the writ, the Cabinet Secretary, the Principal Secretary of the Office of the Chief Adviser, the Secretary of the Ministry of Law and the Private Secretary of the Legal Adviser have been made defendants.
Barrister Shahriar Kabir said that after the August 5 revolution, the current government was formed not only outside the constitution, but also outside the judgment of the Appellate Division of the Supreme Court on the thirteenth amendment of the constitution. If there is no such declaration, the court can declare the current government 'unconstitutional' and replace it through a military coup.
He said, a revolutionary government cannot be overthrown by a military coup or a court verdict. A revolutionary government can be formed under the emergency provisions of the constitution.
The wave of revolution has affected all walks of life including the judiciary, press, administration and a consensus government, which is outside the purview of the constitution as a revolutionary government, the writ petition said. But till date the government has not released any announcement to implement the desire of the movement. They did not even recognize the child of the soil as the freedom fighter of 2024.
The writ petitioner said that the dictator Sheikh Hasina-Sajib Wazed Joy is trying to overthrow the revolutionary government under the Machiavelli theory. It has come to the attention of the nation from the newspapers that she ( Sheikh Hasina ) is going to form the government in exile.
The writ may be heard on Sunday (October 24) in the dual High Court bench of Justice Farah Mahbub and Justice Debashish Roy Chowdhury.
