On Tuesday (October 29), the High Court bench of Justice Farah Mahbub and Justice Debashish Roy Chowdhury gave the order favoring Mirza Fakhrul.
After this order, lawyer Zainul Abedin said, as a result, the party's secretary general Mirza Fakhrul Islam Alamgir will be able to present his statement on behalf of BNP in the hearing of the ruling issued on the question of repealing the fifteenth amendment of the constitution.
Earlier on Monday (October 28) BNP applied to be an intervener in the hearing of the rule issued on the question of repealing the fifteenth amendment of the constitution. Secretary General Mirza Fakhrul Islam Alamgir filed this application on behalf of the party.
It is said in the application that the Awami League and all the opposition parties at that time accepted the demands and introduced the caretaker government system in the constitution through the thirteenth amendment in 1996. As the BNP-led government did not have a majority in the fifth national parliament, it could not be passed in the parliament. That's why after BNP got majority in the 6th National Parliament election, they accepted the people's demand and introduced caretaker government system in the constitution.
But the Awami League government, which was on the way to introduce the system of government, came to power and abolished the caretaker government system through the fifteenth amendment. However, BNP has been carrying out a democratic movement on the streets for almost a decade and a half to return this system of government to the constitution. For this reason, BNP is seeking an opportunity to present its statement to the court as an intervener in this case.
