Maintenance of parents and children must be provided. This is proven by the Qur'an, Sunnah and Ijma. Regarding the maintenance of the child's expenses, it is mentioned in the Holy Qur'an, 'And if they nurse the child for you, give them what they owe. (Surah: Talaq, verse: 6)

And regarding the maintenance of parents' expenses, Allah says, 'And your Lord has commanded not to worship anyone but Him and to be kind to your parents.' (Surah: Bani Israel, verse: 23)

Faqih scholars say that necessary sustenance is included in morality. Rasulullah (SAW) said, 'The best thing a person eats is his own earnings. Surely a person's children are included in his earnings. (Sunan Abu Dawud)

Allama Ibn Munzir (R.A.) said, the scholars have agreed that the poor parents who have neither income nor wealth, it is obligatory to support their children from their wealth.


Similarly, all the scholars have agreed that it is obligatory on the father to support children who do not have wealth. For the child is part of him and he is part of his father. So as it is necessary for a person to spend for himself and his family, it is also necessary to spend for his share and capital. (Al Mughni: 8/171)

If the children have no assets and take a loan for the mother's medical treatment: If they decide at the time of taking the loan that they will repay the loan and claim it, they can take it back.

If the mother is capable, they can ask for the loan they have taken from the mother or can get it back from the abandoned property after the mother's death. And if they do not intend to take back and claim, then in this case they will be considered as voluntary good-doers and they will not have the right to claim later. (Majmool Fatawa: 16/205)
