Jumbangla Desk: Subrata Chowdhury said, don't try to erase national history. Then you will be deleted. He said to the interim government, he has done 10 reform commissions, he has done reforms. But how the judges were appointed before the policy was made. With 15 judges out of court, these should have answers.
He said these things while addressing a discussion meeting on the occasion of Constitution Day at the Supreme Court Lawyers Association Auditorium on Monday (November 4) evening. Bangladesh Democratic Lawyers Association organized this discussion meeting.
Professor Dr. participated in the discussion under the chairmanship of senior lawyer Subrata Chowdhury, president of the association. Syed Anwar Hossain, Supreme Court Bar President Barrister Mahbub Uddin Khokon, constitutional expert Dr. Shahdeen Malik and others.
The founder of the 1972 constitution. Kamal Hossain said that the constitution can be amended if the people think so. Sixteen amendments have been made to the constitution. When it was seen that there is any deficiency in the constitution, the existing provisions are not working in the interest of the people, it has been changed. This is due to the fact that it is a human-made law, which can be corrected if there is any mistake in it or the changing circumstances of time. It has to be done with people. No person or president can change it with the stroke of a pen if he thinks so.
He said, if the majority opinion is formed then the constitution can be approved. This is called sanctity of the constitution. Why call it the basic law? Because it has a status above all laws. It can't be touched in any way. Even the Parliament cannot touch the basic issues.
Dr. According to Kamal Hossain, after the recent events, we have seen that we need to strengthen our legal and institutional protections. We must ensure an independent judiciary. Fair election process should be maintained. Transparency should be brought at all levels. Our Constitution must stand as a bulwark against tyranny. Under whose protection no citizen shall live in fear of injustice and wrongdoing.
He said, we have to work with the new generation. The aspirations of the people of the country should be prioritized. A democratic, just and constitution should stand as a bulwark against tyranny. In today's context, our constitution needs to be reconsidered. We need to ensure that this constitution does not allow for tyranny in any way.
Dr. Kamal Hossain also said, I started the work of protecting people's rights. This painful experience has made it clear to us that the work of protecting the constitutional rights of the people of Bangladesh is not over yet. He said that this constitution was adopted as the foundation of independent Bangladesh on November 4, 1972. The foundation of this constitution was – our sacrifice and collective aspirations. The ideological basis of this constitution was nationalism, socialism, democracy and secularism.
A democratic, just and egalitarian Bangladesh should be built. We have to ensure a non-discrimination Bangladesh. Discrimination on grounds of gender, religion, ethnicity, political or any other identity shall not be allowed. We have to do all the constitutional reforms keeping this goal in mind.'
He said, as lawyers and conscious civil society of Bangladesh - you should participate in this reform process. Share your opinion with the general public. Continue efforts to ensure that the views of the general public are reflected in the amendment process. Be a symbol of strength for the constitution.
He also said that to protect the constitutional rule, people have to be vigilant. The people own the power, the owners have many responsibilities. Every citizen should play the role of watchman.
Dr. Shahdeen Malik said, in 52 years, we have changed the government system 12 times. From 1971 to 1982 we changed the government system 5 times. He said, this ousted government came to power in 2008. Since 2009, we have established a multi-party parliamentary dictatorship. Some African countries have Dictatorship after Parliament.
He said to the interim government, he has done 10 reform commissions, he has done reforms. But how the judges were appointed before the policy was made. 15 judges are out of court. These should have answers.
