On Tuesday (September 24), the High Court bench of Justice Naima Haider and Justice Kazi Zeenat Haque published the 17-page verdict.

The writ petitioner Advocate Mohammad Siddique Ullah Miah confirmed the matter.

Earlier, on January 14, the High Court ordered the appointment of 285 physically challenged persons in government primary schools on the basis of quota.

The High Court bench of Justice Naima Haider and Justice Kazi Zeenat Haque declared the ruling as appropriate. Advocate Mohammad Siddique Ullah Miah was in favor of the writ in the court. Deputy Attorney General Amit Dasgupta appeared for the state.

Advocate Mohammad Siddique Ullah Mia, who wrote the petition after the verdict, said that this judgment of the High Court is a breakthrough in establishing the rights of the disabled. Hopefully, the authorities will immediately implement the judgment of the High Court. Advocate Mohammad Siddiq Ullah Miah handles cases on behalf of the disabled free of charge.

On January 11, the final hearing on the rule issued on the question of quota and appointment of disabled people ended. The High Court fixed January 14 as the day to announce the verdict in this regard. After the final hearing on the rulings issued in four separate writs, the relevant bench of the High Court fixed the date of judgment on December 11.

The writ petitioners applied for recruitment to the disabled quota as per the recruitment circular dated 18 October 2020 published by the Directorate of Primary Education. After passing the written test, he took part in the oral test.


Advocate Mohammad Siddique Ullah Mia said that the final result of the recruitment examination was published on 14 December 2022, where no disabled candidate was given a chance. However, Rule 8 of the Government Primary School Teacher Recruitment Rules 2019 states, 'In the case of filling the female, domestic and male quota mentioned in clause (c) of sub-rule (2), any other rule for the time being in force or any special category by government decision. If a quota is prescribed, recruitment shall be made in accordance with the provisions relating to such quota' and section 35 of the Rights and Protection of Persons with Disabilities Act, 2013 states that 'notwithstanding anything contained in any other law for the time being in force, notwithstanding the qualification, according to the type of disability, suitable No disabled person shall be deprived or discriminated against or prevented from engaging in any activity.'

Due to this, 285 candidates filed four separate writs in the High Court. The High Court issued a ruling in January this year after hearing those writs.
