Dharma Desk: Many times one has to borrow or borrow for the sake of living in the transitory world. However, in this case, the loan taken from someone must be paid on a priority basis. In the Holy Qur'an, it is stated, "Surely Allah commands you to deliver the deposits to those who are entitled to them." And when you judge between people, you will judge based on justice. Surely Allah is giving you good advice. Surely Allah is All-Hearing, All-Seeing. (Surah Nisa, verse: 58)

 

On the other hand, there is a prohibition against defaulting on a loan from someone. In the hadith, Abu Huraira (R.A.) said, Rasulullah (S.A.W.) said, It is oppression to challenge a rich person (to collect a debt). (Sahih Bukhari, 2242)

Even if all the sins of the martyrs in the path of Allah are forgiven, no concession will be given regarding the debt. On the authority of Abdullah Ibn Amr Ibn As (R.A.), Rasulullah (S.A.W.) said, "All the sins of the martyr will be forgiven except the debt." (Sahih Muslim, Hadith: 4730)


If he died without paying the debt, the Prophet (PBUH) would not participate in the funeral of that person until someone had paid the debt on his behalf or taken responsibility for it. He used to ask others to read the funeral of that person.

According to the hadith, Abdullah Ibn Abi Qatada narrated from his father Abu Qatada (RA), once a debtor was brought to the Prophet (PBUH) for Salatul Janaza. Then the Prophet (PBUH) said, "You should perform the funeral prayer for your spouse." (I do not participate in it) because, he remains in debt. Then Abu Qatada said, I am responsible for its debt. Then Rasul (pbuh) said, with the promise of paying it? Then he himself performed the Salatul Janaza of that person. (Tirmidhi, Hadith: 1069)

On the other hand, a person who dies without paying his debt remains in limbo until someone pays it for him. In the hadith, Abu Hurairah (R.A.) said, Rasulullah (S.A.W.) said, "The believer's soul hangs with the debt until the debt is paid." (Tirmidhi, Hadith: 1078; Meshkat Hadith: 2915)
